Work-Visa

Post-graduation work permits (PGWPs) are open work permits given to international students who graduate from a Canadian Study Program. PGWPs allow the holder to work for any employer, for as many hours they wish, anywhere in Canada.

PGWP’s are valid for between eight months to three years and are a great way to obtain valuable Canadian work experience. Once an applicant has work experience in Canada, it opens a lot of opportunities to obtain Canadian permanent residence

Unlike most Canadian work permits, the PGWP does not require a Labour Market Impact Assessment (LMIA). PGWPs enable eligible graduates to gain valuable Canadian work experience. With enough work experience in Canada, many foreign nationals become eligible for Canada’s permanent residency programs, including one of the following pathways:

  • Canadian Experience Class (CEC)
  • Federal Skilled Worker (FSW)
  • Federal Skilled Trades (FST)
  • Provincial Nominee Program (PNP)

PGWP Quick Facts

  1. A post-graduation work permit can be valid for any length of time between eight months and three years.
  2. A PGWP will not be issued for a duration longer than the applicant’s duration of study in Canada.
  3. Generally, the PGWP will be approximately the same duration as the applicant’s period of study, up to a maximum of three years.
  4. If more than 50% of your program of study is conducted via in-person classes, you are eligible for a PGWP equal to the duration of your program of study.
  5. If you studied part-time, or did accelerated studies, the length of your PGWP will be the length of your program of study, if taken full-time.

Spousal Based Open Work Permit and Extensions:

About the Spouse/Partner Work Permit

  • If you are an international student studying full-time with a valid study permit, your spouse or common-law partner can apply for an open work permit. Having an open work permit enables your spouse or partner to work for any employer while you study.
  • An open work permit is a work permit that is not job specific. It allows your spouse or common-law partner to accept any job with any employer. If your spouse or partner gets an open work permit, it is normally valid for the same period as your study permits.

What is spousal work permit extension in Canada?

If you want to extend your stay in Canada as an open work permit (stay in Canada longer), you need to qualify first.

To qualify applicants must:

  • Be living in Canada.
  • Have temporary resident status or are eligible to restore their temporary resident status (as a visitor, student or worker).
  • Live at the same address as their spouse.

Employer Specific Work Permit and Extensions:

Employer Specific Work-Permit

Foreign nationals who are looking to work in Canada are most likely to obtain a closed work permit with or without Labour Market Impact Assessment (LMIA). This is also called and referred as Employer-specific Work Permit.

Canadian Work Permit, or a Work Visa, is issued to eligible overseas individuals to work in the country for a specific period of time.

Applicants need to apply for a Work Visa only after getting a job offer or an employment contract from a Canadian employer. The employer must obtain from ESDC (Employment and Social Development Canada) an LMIA (Labour Market Impact Assessment), which gives them permission to recruit foreign skilled workers for occupations that cannot be filled in by citizens or permanent residents of Canada.

Limitations of Employer-Specific Work Permit

This work permit allows you to work according to the conditions on your work permit, which include:

  • Name of the employer
  • Duration of the employment
  • Job Location

Work Permit Extensions

  • If you want to extend your stay in Canada, you should apply at least 30 days before your status expires.
  • If your permit expires after you submit your application for extension but before you receive a decision on your application, you can stay in Canada under what is called implied status.

You May Get an Extension If

  • Your employer receives a new labour market opinion.
  • You both signed a new employer and employee contract.
  • You apply for a new work permit before your current work permit expires.
  • You should submit your application before your current work permit expires which will allow you to stay in Canada until decision is made.
